GENERAL TERMS AND CONDITIONS
These general terms and conditions are available at all times and systematically brought to the knowledge of each customer / user in order to enable him to place an order. Thus, placing an order and ticking the box “I accept the general terms and conditions” during the payment process implies the full and unreserved acceptance of the customer to these general terms and conditions.
ARTICLE 1 – CONCEPT
Get Out! Is a life-size escape game concept belonging to the company VLS ENTERTAINMENT. These general terms and conditions apply to any contract for the provision of a gaming room between (1) any VLS ENTERTAINMENT group company (a company belonging to the group, a company linked to VLS ENTERTAINMENT by a franchise / license agreement GET OUT “and (2) the users of the room, who will be named” USERS “afterwards; Whether they have booked personally or are part of the team of the person making the reservation, hereinafter referred to as “THE BUYER”. These conditions also apply whatever the means of reservation, whether this is done via the website of VLS ENTERTAINMENT, hereinafter referred to as “WEBSITE”, or to the personnel of the different places of exploitation of the GET OUT! brand. The playing space available to the players is called « ROOM” and the contract of provision “CONTRACT”. The game portion for which the BUYER reserves and pays on the WEB SITE is called « GAME SESSION”.
VLS ENTERTAINMENT acknowledges the right to modify or have modified all or part of the present general terms and conditions as well as the contents of its WEBSITE (http://www.getout.fr et https://cherbourg.getout.fr/), at its sole discretion, at any time and without prior notice.
The general terms and conditions of VLS ENTERTAINMENT are available on the WEBSITE and can be consulted freely on simple request from the reception staff of GET OUT.
ARTICLE 2 – PROVISION AND USE OF THE ROOM
According to the principle of the game, GET OUT grants the USERS the right to occupy the ROOM for a maximum duration of 60 (sixty) minutes. The occupation of the ROOM is for the sole and exclusive purpose of taking part in a game organized by GET OUT, which must be carried out in teams of 3 to 6 people maximum.
USERS agree that the length of time in the ROOM is 60 minutes maximum, that they have managed to find all the clues and to solve all the puzzles or not. At the same time, USERS agree that the game will stop before the end of the 60 minutes, in particular if they have managed to find all the clues and solve all the puzzles in less than 60 minutes; without being subject to any adjustment or tarif compensation.
Admission to the ROOM is only possible upon presentation of the reservation confirmation email (sent shortly after the payment process to the BUYER) and on presentation of a document of identity of the latter.
The complexity of the game does not allow USERS whose age is less than 12 years old to participate. Minor USERS under 15 years old must be accompanied by an adult. Minor USERS over 15 years old do not necessarily have to be accompanied by an adult. In case of doubt about the age of a USER, GET OUT reserves the right to ask for a proof of identity.
USERS are required to maintain the ROOM and all of its equipment (unrestricted list: decorations, furnishings etc.) in good condition and to use it in accordance with the authorized use. Therefore, the USER acknowledges to the CONTRACT that any deliberate degradation or caused by unauthorized manipulation of the room and its equipment will be recharged.
Furthermore, the USER is obliged to use the ROOM and its equipment in such a way as not to cause or risk causing any damage to the other USERS, the premises and equipment of GET OUT.
Throughout his presence at the premises of GET OUT, the USER agrees to behave in a respectable manner, to comply with the rules and to cooperate with the staff of GET OUT. As such, GET OUT does not tolerate any form of violence, whether verbal or physical, in the form of harassment or intimidation of its employees and thus reserves the right to refuse access to premises to any person whose behavior would be similar to the elements cited above. GET OUT also reserves the right to refuse access to any person under the influence of alcohol or drugs and this as a security measure for the said person and his entourage. For all the above mentioned conditions, the prohibition of access gives no right to any compensation or refund.
Due to the nature of the game, no recording can be made in the ROOM. Thus, the use of video and / or audio recording devices (including but not limited to: mobile phones, cameras, Go Pro) is strictly prohibited. Any use of such a device may cause the game to stop completely and for the entire team.
GET OUT expects its USERS to not disclose the details of the game directly and / or indirectly. Any partial or total disclosure would violate the commercial interests of GET OUT.
ARTICLE 3 – PRIZES
The prices charged by GET OUT are indicated on the WEBSITE in the “Reservation” section and are also displayed at the reception of the GET OUT premises.
The prices indicated by GET OUT! are in euro, including all taxes, taking into account the VAT applicable on the day of the order, any change in the rate that can be passed on to the price of services.
GET OUT! reserves the right to change prices on its website at any time.
In all cases, the service will be invoiced on the basis of the rates in force and mentioned on the site at the time of booking.
If only two USERS wish to participate in the game, a SESSION for three USERS must be booked.
All other services will be invoiced separately.
GET OUT reserves the right to modify its rates at any time. Any BUYER will pay the applicable rate at the time of booking.
GET OUT! accepts different types of payments depending on the city and the institution in question.
ARTICLE 4 – BOOKING
The provision of a SALLE is subject to the booking and its payment in advance. This is done by the BUYER on the GET OUT WEBSITE.
All bookings are made from the WEBSITE and according to the availabilities displayed on it. The booking is only confirmed and confirmed after receipt of the reservation confirmation email, which is sent to the BUYER at the end of the payment process.
In exceptional cases, GET OUT staff may make the booking on behalf of the BUYER if the BUYER can not make the reservation on the WEB SITE. In these specific cases, the BUYER accepts without any reservation that this type of booking does not entail any responsibility on the part of GET OUT or its staff, the staff then acting only as operator of seizure according to the Instructions given by the BUYER. The BUYER therefore waives all recourse due to misuse, breach of confidentiality of his data or fraudulent use of his account.
The WEB SITE is available in French and English. However, in case of dispute, only the French version of the WEBSITE and the general conditions of sale may be opposed to GET OUT.
A reservation can not be transferred or resold for commercial purposes. If a reservation is transferred or resold in violation of this section, the holder thereof will be denied access.
In case of delay of the USERS for a reserved SESSION, GET OUT may decide whether or not to start the game. In all cases, the ROOM must be vacated at the time stipulated in the initial reservation. GET OUT reserves the right to refuse access to USERS whose delay amounts to 15 minutes or more. The schedules will be systematically recalled in the confirmation emails sent by GET OUT.
If fewer USERS show up to participate in the Game SESSION than what was originally scheduled at the time of booking, BUYER and / or USERS are not entitled to reimbursement of the difference in price.
If more USERS show up to participate in the Game SESSION than what was originally scheduled at the time of booking, the prize difference must be paid before participating in the game, within the limit of 6 players (USERS) authorized by ROOM.
GET OUT reserves the right to refuse any reservation to a BUYER who has not paid all the services invoiced to him.
ARTICLE 5 – RIGHT OF RETRACTION
In accordance with Article 121-21-8 of the Consumer Code, the right of withdrawal may not be exercised for contracts for the provision of accommodation services, other than residential accommodation, services for the transport of goods, Car rentals, catering or recreational activities that must be provided at a specified time or date. Therefore, no booking can be canceled or refunded except in the case of a cancellation by the sole fact of GET OUT. In the latter case, the amount of the initial reservation will be reimbursed.
ARTICLE 6 – RECORDS OF THE MONTH
Each month, GET OUT organizes the “Records of the Month” operation. This operation aims to highlight the teams having achieved the best scores for each of the ROOMS proposed by GET OUT. To participate, the teams must realize (for the first time) one of the GET OUT puzzles and leave the ROOM in record time. This record time depends on the scores made by the other teams for the same ROOM between the 1st day of the month and the last day of the current month.
As mentioned above, the enigma must be performed for the first time by all the participants. The scores achieved by a team of which one or more participants have already completed the enigma concerned previously can not be considered as “records”. In this case, GET OUT reserves the right to validate or not the record, in its sole discretion.
ARTICLE 7 – PERSONAL DATA
The BUYER is responsible for the accuracy of the information entered on the online booking form on the WEBSITE.
The BUYER agrees to receive from GET OUT information and commercial offers on his email address or on his mobile phone by clicking on the authorization box of the WEB SITE.
The BUYER and / or the USER who enters his telephone details on the WEB SITE of GET OUT already agree to be contacted by GET OUT and this by telephone or SMS.
The BUYER informing the contact information of the other players / USERS (names and first names, telephone numbers, email addresses) authorizes GET OUT to send information and commercial offers to the latter.
GET OUT undertakes not to transmit the personal data of its USERS to a company outside the VLS ENTERTAINMENT group, without the request of an authority authorized by law and within the framework of the legal provisions in force.
ARTICLE 8 – SAFETY
The USER undertakes to comply with all security measures given to him, whether contractual, posted on site or given orally by GET OUT staff.
It is strictly forbidden to smoke inside the site.
Each USER agrees to read and observe the safety and fire protection instructions as well as the emergency exits. These are clearly identified in the GET OUT room. As such, it is strictly forbidden to interfere with emergency exits, which must remain clear in all circumstances. The USER may use emergency exits if and only if the situation requires the evacuation of the premises (fire, for example). Any abuse and / or untimely opening of these issues by one or more USERS will result in the re-invoicing of the costs occasioned by this abuse.
USER is aware that it is absolutely forbidden to bring objects (1) of physical hazards (explosive, flammable, oxidizing, gas under pressure or liquefied, corrosive) into the rooms, (2) dangerous for health (Toxic, corrosive to the skin, irritant / sensitizing, carcinogenic / teratogenic) and (3) hazardous to the aquatic environment.
ARTICLE 9 – PHOTOS AND CAMERAS
Photos of each USER team can be taken before or after the game session. These photos can be used by GET OUT to feed its WEB SITE or its digital ecosystem (Unrestricted Examples, Facebook, Twitter, Instagram etc.).
GET OUT can not be held responsible for the use of the photos by the USERS and / or the BUYER.
Each ROOM features a video surveillance and listening device allowing GET OUT staff to follow the game session and help USERS if necessary. This device only contributes to the game and does not record the USER SESSIONS of the game.
ARTICLE 10 – COMPETENT TRIBUNALS
These general terms and conditions and any contract concluded incorporating these terms and conditions are governed by French law and all disputes are subject to the exclusive jurisdiction of the French courts.
